General terms & conditions
When you register a property with Hometraveler BV, you agree to the following terms and conditions:
Hometraveler BV reserves the right to refuse any property advertisement and cannot be held liable for any expense or loss as a result of doing so. Hometraveler BV reserves the right to modify the property information as per their requirements; to remove any offensive or inappropriate material and not to refund any fee paid, if it is found that:
a) there is misrepresentation of the property
b) there is double booking of property without separately registering the same
c) substantiated complaints are received from holidaymakers who book an advertisers property.
Hometraveler BV is licensed to publish part or entire material supplied by the Advertiser. Hometraveler BV may refuse to provide any hyperlinks to other websites.
The advertiser of the property is wholly responsible for the accuracy of the property information published on the site. Advertisers should respond promptly and courteously to all enquiries to render effective service to the renters/tenants. Advertisers should update the availability of the property. Advertisers are required to have a legal contract with their tenants. Hometraveler, cannot be held liable for cancellation of booking/contract, non-payment of rent, damage to the property or any other material/financial loss. Any request for removal of a property from the website should be done via email or in writing. Advertisers are not eligible for any refunds if they request for removal of advertisement before the end of their subscription period.
Fees
Hometraveler BV will collect a fee of 10 % per booking from the total rental amount payable to advertisers if the booking is a confirmed one. The Homeowner or his Agent is responsible to take care and provide all the eligible services to the renters at arrival as mentioned previously in the Terms and conditions. Hometraveler BV accepts no legal responsibility for the accuracy of information, or for any action brought against the advertiser for breach of contract by the person or people renting the holiday property. Hometraveler BV shall not be liable to the advertiser or owner for any loss, costs or damages resulting from the use of the site, or the inability to access or use the site.Hometraveler BV cannot be held responsible for any infringement of copyright laws resulting from material supplied by the advertiser.
Business Venue
Hometraveler BV doing business in the name and style Hometraveler BV, Amsterdam and act as an intermediar for the owners/caretakers/authorized In-charge of holiday accommodation (the owner/ caretakers/authorized In-charge) arranging and making bookings and reservations for holiday makers (the client). Each contract is therefore between the Owner and the Client and is made at the point at which Hometraveler BV issue a Booking Confirmation. The person signing the booking form certifies that he/she is authorized to agree the booking conditions of all persons included in the party. The signatory must be a member of the party and must be over 18 years of age.
Cancellation protection scheme
The weekly rent includes cancellation protection in order to cover repayment of contractual charges relating solely to accommodation for which you are legally liable but cannot take up due to:
(a) Death, illness, quarantine or bodily injury
(i) of you or any member of your party and/or (ii) of the wife, husband, parent, parent-in-law, child, sister, brother, fiancé(e) or close business associate of you or any member of your party (excluding pets).
(b) Being summoned for Court Service or witness attendance in a court in the Netherlands.
(c) Police requiring you to return home following theft at your home or place of business or damage rendering your home or place of business uninhabitable.
(d) Occupational Posting of a military nature or cancellation of leave or an unexpected overseas posting of Insured person/s or any person/s with whom the insured has arranged to travel. It is a Condition Precedent that you and all members of your party deemed to be covered are in good health physically and mentally at the time of booking. The Scheme does not cover claims directly or indirectly resulting from or consequent upon: Winter sports, mountaineering (normally involving ropes and/or guides) tours, motor competitions; any recurring, chronic or continuing illness, disability or condition of any of the persons covered, for which medical treatment or consultation has taken place immediately preceding the date of booking the holiday; war and kindred risks; disinclination to travel; failure of public or private transport services; suicide, attempted suicide, insanity, the influence of intoxicating liquor or the effect of drugs not taken in accordance with treatment prescribed and directed by a qualified medical practitioner or booking a holiday which would be against the advice of a registered medical practitioner; pregnancy unless occurring after the inception of the insurance; any loss which is otherwise insured. Hometraveler BV can under no circumstances held responsible.
Procedure for Claims
Claims must be made through Hometraveler BV and sent within 7 days of notification. All claims must be made at least 10 days prior to the start date of any holiday booked. An administration charge of € 125 will be made to cover some of our overheads and expenses thus incurred. Any claim must be supported by Written Evidence from a fully qualified medical practitioner, or government official as appropriate.
Cancellation by the Hometraveler BV
If Hometraveler BV have to cancel a booking of a specified property at any time after confirming a booking (e.g. because of flood or fire at the property) or should the property be unavailable on the day that the holiday starts for reasons outside Hometraveler BVs control then Hometraveler BV will offer the Client the choice of: Another alternative property (subject to availability) or A full refund of the amount paid by the client to Hometraveler BV. The Client shall have no further claim against the Owner or Hometraveler BV.
Complaints
Any complaint should be directed in the first instance to the Owner/Caretaker/Authorized In-charge. If this is not possible, the Client should contact Hometraveler BV and between them the Owner and Hometraveler BV will endeavor to put matters right straight away. Failing this, the Client should complete the Complaints Form/Questionnaire, which is sent with the final booking confirmation, and the form should be returned to Hometraveler BV within 7 days of the end of the holiday.
Breach of contract
If there shall be a breach of any of these conditions on the part of the Client or any member of the party, the Owner and Hometraveler BV reserve the right to re-enter the property and terminate the holiday letting without prejudice to the other rights and remedies of the Owner. The validity construction and performance of this contract shall be governed by Dutch Law and the Client hereby submits to the exclusive jurisdiction of the Dutch Courts.
Copyright
All right, title and interest in and to all content, text, images and other materials on the Site are either owned or licensed by us or by a third party, and are protected by copyright, trademark. We have tried to make the contents as clear as possible. Anything copied without our express permission or as per the terms of use stated above/stolen from Hometraveler BV will result in legal action taken against the individual or the company immediately. If any one is found using our material, we will notify the concerned immediately and initiate action to have the site removed from their index permanently. We will also take legal action for infringement of copy right and possible damages caused.
Indemnity
You agree to defend, indemnify and hold harmless Hometraveler BV its officers, directors, employees and agents, from and against any claims, liabilities, damages, losses and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Site or your violation of these Terms of Use.
Limitation of Liability
The aggregate liability of Hometraveler BV to you for any and all claims arising from the use of the site, content or services is limited to the amounts you have paid to Hometraveler BV, for access to and use of the site.
Construction
In the event that any provision of these Terms of Use is held to be invalid or unenforceable, the remaining provisions of these Terms of Use will remain in full force and effect. The failure of Hometraveler BV to enforce any right or provision of these Terms of Use will not be deemed a waiver of such right or provision.
Controlling Law and Jurisdiction
These Terms of Use and any action related thereto will be governed by laws and regulations of the Netherlands.
Booking Terms and Conditions
1. General
These terms and conditions including your booking details of the accommodation are the base of the conditions of your agreement with the provider of the Exchange/Rent holiday accommodation of which Hometraveler BV is only acting as an intermediary.
2a. Booking
After you have chosen your Exchange/Rent holiday accommodation and confirmed the booking you agree to pay a deposit of 25% or the total amount of the booking when this booking is within 6 weeks of your arrival.
The balance of the total costs of your accommodation is due to at least 6 weeks before arrival. If this is not received in time Hometraveler BV will cancel your booking and charge cancellation fees in accordance with these booking conditions. The total costs of your accommodation may not include any extra chargeable services such as linen and cleaning but these are clearly stated on the booking confirmation. You are responsible for making all payments due, notifying us if any changes or cancellations are required and for receiving the confirmation and keeping your party informed. When we have your confirmation and send you the invoice for the deposit/full payment, your booking is confirmed and a contract between you and the accommodation provider is officially established.
In case there is any information related to your booking incorrect please report this to Hometraveler BV immediately because there will charges for later modifications or cancellations. When you make and confirm a Rental/Exchange booking for a holiday accommodation you guarantee you have the authority to accept, and do accept on behalf of your party, these booking terms and conditions. Hometraveler BV reserves the right to alter any of our advertised prices. You will be advised of the current price of the accommodation that you wish to book before your contract is confirmed.
2b. Change your booking
Any requests for changes regarding your booking can only be send to us in writing, by email, by fax or mail by the person who has made the payment/booking. Hometraveler BV cannot guarantee that we will be able to accommodate your request but we will try to do so. You will be liable for an administration fee of 45 Euros plus any cancellation or upgrade charges which may be applicable.
You will be charged the following cancellation fee(s) when we make costs in cancelling confirmed bookings, if cancellations are received:
- more than 35 days before arrival date = 10% of the total booking costs
- 35-30 days before arrival date = 50% of the total booking costs
- Less than 30 - 2 days before arrival = 80% of the total booking costs
- 2 days before, arrival date of the total booking costs
Your booking costs are non-refundable unless your cancellation is covered under the terms and conditions of your insurance policy.
Hometraveler BV reserves the right to change or cancel your booking (this does not apply where the change is not material eg, but not limited to, temporary withdrawal of facilities or seasonal unavailability or amenities) if you don't agree or accept this, you can take any alternative accommodation of which Hometraveler BV is able to offer you for the booked amount, if the amount is higher you will pay the increase in cost or receive a refund of the difference if it is less expensive or a refund of the money you have paid to us.
Any changes or cancellation fees you incur in terms of other arrangements you have made with other providers are not claimable from Hometraveler BV. Note: Hometraveler BV will have no liability if a change or cancellation occurs because or circumstances beyond our control, for example war riot, industrial dispute, actual or threatened terrorist activity and its consequences, natural or nuclear disaster, fire, adverse weather conditions, flood, epidemic or pandemic illness and all similar situations and no compensation, costs, expenses or any other sums, including the cost of securing alternative accommodation will be paid by Hometraveler BV.
It is the responsibility of the person(s) that make/confirm the booking to ensure that they are adequately insured. Hometraveler BV strongly advices you take verify with your insurance to cover any possible costs against cancellation charges and assistance (including repatriation) in the event of accident or illness plus cover for accidental damage to the owners' property.
3. Hometraveler BV
Hometraveler BV is acting only as an intermediary between the property owner and renter/exchanger. Hometraveler BV has the responsibility to select the accommodation providers with reasonable knowledge and care. For the actual provision of the accommodation Hometraveler BV has no liability to you. Hometraveler BV has no liability in the following situations:
-when the renter(s)/exchanger(s) incurs any loss or damage that relates to any business activity
-when any loss or damage relates to any service which does not form part of Hometravelers terms & conditions with you.
-when the Rental/Exchange holiday accommodation cannot be provided as booked due to circumstances beyond Hometraveler BV’s control
-when the renter(s)/exchanger(s) incurs any loss or damage that could not have been predicted at the moment of the booking and based on the information provided by the renter/exchanger
4. During your stay
When you have booked a holiday Rental or Exchange accommodation through Hometraveler BV, you accept the responsibility for the proper behavior of everyone of your party, including visitors or guests during your stay. If you cause any damage to the accommodation, you must inform the keyholder immediately and fully reimburse the accommodation provider for the cost of the damage. You must also indemnify Hometraveler BV for the full amount of any claim (including legal costs) made against us by the accommodation provider or any third party as a result. Hometraveler BV reserves at any time the right to end the stay of any party member(s) whose behavior is such, in the reasonable opinion of the accommodation provider, local keyholder or agent as to cause or to be likely to cause danger, upset or distress to anyone else or damage to the property. If this is the case no refund will be given and Hometraveler BV shall be under no obligation whatsoever has to pay compensation or meet any costs or expenses that you might incur as a result of the ending of your stay.
5. Arrival & Departure
Arrival is in general between 15:00pm and 19:00pm unless this is stated differently on your bookings confirmation. Hometraveler BV will provide you with the details such as name, address and telephone number of the local keyholder or agent including the directions to the address. Hometraveler BV cannot guarantee that keys will be available at unsocial hours and you may have to wait until the following day. If you have difficulties and are not able to arrive to collect the key to your holiday Rental/Exchange accommodation between these times, you must advise the local keyholder or agent in advance.
6. Inquiries and Complaints
When during your stay you have any problem related to the accommodation, we advice you to contact the keyholder or local accommodation provider immediately. If your complaint is not solved on the location, we would like to ask you to send a written complaint to our customer service department within 14 days of departure giving us your booking reference number, and all specific information regarding this complaint in order for us to process this complaint further. If you are unable to this simple procedure Hometraveler BV has been deprived of the opportunity to investigate and rectify your complaint and this may affect your rights stated under these terms and conditions. We agree that the courts of Netherlands and Amsterdam have jurisdiction and under all circumstances Dutch law applies.
